Fran Hoffinger

Fran Hoffinger is a member of Hoffinger Stern & Ross LLP. Her practice focuses on white and non-white collar criminal litigation and civil litigation, both state and federal. She also practices in the area of Family Law.

Most recent white collar criminal cases and investigations run the gamut from fraud to embezzlement, including, for example, the representation of individuals and/or business entities in medicaid fraud and sales tax evasion investigations, and individuals accused of mail fraud, theft of government funds, embezzlement and larceny. Ms. Hoffinger has also represented clients under investigation for or accused of non-white collar crimes such as larceny, assault, homicide, sexual abuse, aggravated harassment and driving while intoxicated. In addition, she has also represented victims of crimes and witnesses in criminal proceedings.

Recent civil cases have included representing individuals and business entities in matters involving partnership disputes, shareholder derivative issues and misappropriation of trade secrets and property, conversion of property, professional malpractice, and litigation involving cooperatives and condominiums. Family law matters include custody, visitation and child support issues, as well as separation and divorce.

Ms. Hoffinger has appeared in State Courts (Appellate Division, Supreme Court, Criminal Court, Civil Court, Family Court, Housing Court and Surrogate's Court) and Federal Courts (District Court, Magistrate's Court and Bankruptcy Court).

Prior Work Experience

After being graduated from law school, Ms. Hoffinger worked at the Criminal Defense Division of the Legal Aid Society in New York County for seven years, first as a staff attorney and then as a supervising attorney. At Legal Aid, Ms. Hoffinger was responsible for hundreds of felonies and misdemeanors, handling the cases from arraignment through trial or disposition. Felony trials included charges such as robbery, burglary, attempted murder, grand larceny, bribery and assault. She also conducted hundreds of suppression hearings. As a supervisor, Ms. Hoffinger participated in training programs for junior attorneys, including "second seating" them at trial and other forms of supervision.

After the Legal Aid Society, Ms. Hoffinger worked for Hoffinger Friedland Dobrish Bernfeld & Hasen, later Hoffinger Friedland Dobrish Bernfeld & Stern, concentrating in criminal and civil litigation, continuing to do trial work.

Education

Ms. Hoffinger received her J.D. from Fordham University School of Law in 1984, where she was a member of the Urban Law Journal (Author, Comment, "Environmental Impact Statements: Instruments for Environmental Protection or Endless Litigation", Fordham Urban Law Journal, Vol. XI, No. 3, 1983), the Sutherland Moot Court Team (Constitutional law) and the Moot Court Board. She was awarded Runner Up Best Oralist in the Mulligan Moot Court Competition in 1982.

Ms. Hoffinger received a B.A. (cum laude, with Distinction in All Areas) from Cornell University, College of Arts & Sciences in 1981. She attended the London School of Economics in 1979.

Bar Admission and Activities

Ms. Hoffinger is admitted in New York State and in the Southern and Eastern Districts of New York. She is a member of the Association of the Bar of the City of New York (Member, Committee on State Courts of Superior Jurisdiction 2006-Present) and the New York Criminal Bar Association. Ms. Hoffinger has served as the Administrator for the New York County Democratic Party's Independent Screening Panel for Civil Court Judges (Spring 2007) and as a panel member (Spring 2005).

Ms. Hoffinger has an AV rating from Martindale Hubbell.
